Terms of service
The rules for using PortlandBread, in plain language wherever we can manage it.
These Terms of Service ("Terms") are an agreement between you and Scored Media LLC, an Oregon company that owns and runs PortlandBread ("PortlandBread," "we," "us"). They cover portlandbread.com, the Friday newsletter, the forms on the site, and the featured badge (together, the "Service").
By using the Service, you agree to these Terms. When you sign up for the newsletter or send us a form, you're agreeing to them directly, which is why there's a note next to those buttons. If you don't agree, please don't use the Service.
1. What PortlandBread is
PortlandBread is a free, independent editorial guide to bakeries, pastry shops, and cake and cupcake shops in and around Portland, Oregon. We write listings, lists, bread walks, and Journal pieces. There are no user accounts, nothing for sale, and no ads. Shops can't pay to be listed or ranked, and we aren't affiliated with any bakery we cover unless we say so on the page.
2. A guide, not a guarantee
We check what we publish against the shops' own websites and signs, and we date what we can. Still, hours change, menus rotate, and shops move or close, sometimes the same week we write about them. So:
- Treat every listing, hour, address, price, and menu item as a starting point. Confirm with the shop before you make a trip, especially a long one.
- When we say "call first," we mean it. It's how we mark hours we don't have or haven't checked in the last 60 days.
- Being listed isn't a guarantee about a shop's products, service, prices, or safety. A shop's goods and conduct are the shop's responsibility, not ours.
- Our picks are opinions. Reasonable people disagree about croissants.
If something's wrong, tell us and we'll fix it.
3. Dietary and allergen information
This one matters most, so we'll be direct. When we call a shop vegan, list vegan items, or call a kitchen dedicated gluten-free, we're reporting what the shop says on a page it controls, with a link so you can read it yourself. How we decide explains the rules.
We don't inspect kitchens, test food, or audit suppliers. Recipes and suppliers change, and cross-contact can happen even in careful kitchens. Our dietary notes are general information. They aren't medical or nutritional advice, and they aren't a promise that any item is free of an allergen.
If you have celiac disease, a food allergy, or another condition where a mistake could hurt you, confirm with the shop directly every time before you eat. You're responsible for that decision, and you rely on our dietary notes at your own risk.
4. Who can use PortlandBread
Anyone can read the site. It's meant for a general audience and isn't directed to children under 13. If you're under 13, please don't sign up for the newsletter or send us a form. If we learn we've received personal information from a child under 13, we'll delete it.
5. Things you send us
When you use the contact, correction, or add-your-bakery forms:
- You're telling us that what you send is accurate as far as you know, and that it's yours to share.
- You give Scored Media LLC a free, non-exclusive, worldwide, permanent license to use, edit, and publish it, with or without your name, as part of running the guide. For example, we might quote your correction or use your tip to update a listing.
- We don't have to publish, act on, or reply to anything, and sending a bakery doesn't mean we'll list it.
- Please don't send anything confidential, anyone else's private information, or anything unlawful.
Forms are delivered to us by email through a third-party service. See the Privacy policy for details.
6. Using the site fairly
Please don't:
- Use the Service for anything unlawful, fraudulent, or harassing.
- Scrape, crawl, or bulk-download the site, or copy our listings, lists, or writing into another product, database, app, or AI training set, without our written permission. Ordinary search-engine indexing and the pages in our robots.txt are fine.
- Try to break, overload, probe, or get around the site's security.
- Pretend to be PortlandBread or suggest we endorse you when we don't.
- Send fake corrections or listings, or submit forms on someone else's behalf without their permission.
7. Our content
The writing, photographs, illustrations, maps styling, lists, the way our listings are compiled, the PortlandBread name, and the stamp logo belong to Scored Media LLC or to the people credited on the page. These Terms don't transfer any of those rights to you.
You're welcome to link to any page, share it, quote a short passage with credit and a link, and print a bread walk for your own use. Anything beyond that, like republishing a full piece or reusing photos, needs our permission. Just ask.
8. The featured badge
If your bakery is in the guide, you can use the badge from our badge page under a limited license. It's free, non-exclusive, non-transferable, and we can revoke it at any time. To use it:
- Show it as we provide it. Don't change the artwork, colors, or wording.
- Use it only while your shop is listed, and link it to your PortlandBread page where you can.
- Don't use it in a way that suggests we endorse something we haven't written about, or combine it with your own logo into a new mark.
If we ask you to stop using the badge, or your shop leaves the guide, please take it down promptly. We keep all rights in the badge and the PortlandBread name.
9. Copyright complaints
If you believe something on PortlandBread infringes your copyright, send a complaint through our contact form and include:
- the work you believe is infringed, and where it appears on our site;
- your name, address, phone number, and email;
- a statement that you believe in good faith the use isn't authorized by you, your agent, or the law;
- a statement, under penalty of perjury, that your notice is accurate and that you own the copyright or are authorized to act for the owner; and
- your physical or electronic signature.
We'll review it and remove or change the material when that's warranted. If your material was removed and you think it was a mistake, you can send a counter-notice through the same form.
10. Other sites and services
We link to bakeries' websites, sources, and other pages we don't control. We aren't responsible for their content, accuracy, availability, or privacy practices.
Maps on PortlandBread use Google Maps. By using the maps, you agree to the Google Maps/Google Earth Additional Terms of Service and the Google Privacy Policy. Directions come from Google, not from us, so check them against the street you're on.
The site also depends on outside providers, like our host and our form and email services. We'll try to keep things running, but we can't promise those services will always work.
11. Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We don't warrant that the Service will be uninterrupted or error-free, or that any listing, hours, dietary note, map, or direction is accurate, complete, or current. We make no warranties about any bakery or its products.
12. Limits on our liability
To the fullest extent the law allows, Scored Media LLC and the people who write for PortlandBread won't be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or opportunities, arising from or related to your use of the Service. That includes a wasted trip, a closed shop, a sold-out case, a wrong direction, or a reaction to food you chose to eat based on something you read here. Because the Service is free, our total liability for all claims in any 12-month period won't be more than US $50.
Some places don't allow certain warranty exclusions or liability limits, so parts of Sections 11 and 12 may not apply to you. Nothing in these Terms limits liability that can't be limited by law.
13. Indemnification
If a claim is brought against us because of something you sent us, your breach of these Terms, or your violation of the law or someone else's rights, you agree to cover our reasonable costs and losses from it, including reasonable attorneys' fees.
14. Changes to the Service, and ending access
We can change, pause, or stop any part of the Service at any time. We can also block access for anyone who breaks these Terms or puts the site or other readers at risk. You can stop using the Service, or unsubscribe, whenever you like. Sections 3, 5, 7, and 11 through 15 still apply after that.
15. Oregon law and disputes
These Terms are governed by the laws of the State of Oregon and applicable US federal law, without regard to conflict-of-law rules. Any dispute will be handled in the state or federal courts located in Multnomah County, Oregon, and you and we both agree to those courts' jurisdiction.
To the extent the law allows, you and we each agree to bring claims only individually, not as a plaintiff or class member in a class or representative action, and each of us waives the right to a jury trial.
16. The rest
If a court finds part of these Terms unenforceable, the rest still applies. If we don't enforce a term right away, we haven't waived it. These Terms, together with the Privacy policy and Editorial policy, are the whole agreement between you and us about the Service. You can't transfer your rights under them; we can, for example if the site changes hands.
17. Changes to these Terms
We'll update these Terms when the site changes. The date at the top shows the current version. If a change is significant, we'll also note it on this page and, if you get the newsletter, mention it there. If you keep using the Service after a change takes effect, you accept the updated Terms.
18. Contact
